Terms of Service

These are the terms for using MBIImix Water Solutions to buy prepaid water credit for your meter. Using the service means you accept them.

What the service does

You pay by M-PESA and we ask the meter vendor to issue a token. You key that token into your meter, and the meter adds the credit. We do not supply the water itself and we do not own the meter. Your landlord does.

What you can do without an account

You can pay for any meter using only its number, and the token goes by SMS to the M-PESA number that paid. That is deliberate, so a relative or a landlord can top up someone else's meter. Seeing a meter's balance, usage or past tokens needs an account and a code sent to the phone number already held against that meter.

Tokens

A token is worth the water it was bought for, to whoever types it in. Treat it like cash. Once a token has been entered into a meter it cannot be reissued, moved to another meter, or refunded.

Balances and readings

Most meters on this platform are standalone keypad meters with no AMI module. They do not report anything back, so the app cannot show a live balance for them and will say Not available rather than show a number it does not have. The balance on the meter's own screen is the one that counts.

Payments that do not produce a token

A payment can succeed while the token fails, usually because the vendor's system is unreachable. Each payment can only ever produce one token, so a retry cannot give you two and a repeated confirmation cannot charge you twice. If a payment leaves your account and no token arrives after we have retried, that is a refund rather than a second attempt. Contact your landlord, who can see the payment and the token.

Getting it wrong

Check the meter number before you pay. We cannot recover credit sent to a meter number you typed incorrectly, because the token has already been issued against that meter and belongs to whoever owns it.

Support

Your landlord supports you. They can see your payments, the token issued and its status, and can send it again. We support landlords.

Availability

We depend on Safaricom, on the meter vendor and on an SMS provider, and any of them can be unavailable. We do not promise the service is always up. Your saved tokens remain readable on your phone when it is not.

Misuse

Do not try to reach meters or accounts that are not yours, and do not attempt to obtain tokens you have not paid for. Accounts doing so are suspended.

Refunds

If a payment leaves your account and no token is issued after we have retried, we refund it in full to the M-PESA number that paid, within five working days of the payment being confirmed as unfulfilled. We do not refund a token that has already been entered into a meter, because the water has been supplied. We do not refund a token sent to a meter number you typed incorrectly, because it was issued against that meter and belongs to whoever owns it.

What we are responsible for

We are responsible for issuing a token for a payment we have confirmed, and for refunding you if we cannot. Our liability for any one transaction is limited to the amount you paid for it.

We are not responsible for the water supply itself, the condition of the meter, or the tariff your landlord sets. Those are between you and your landlord. We are not responsible for losses caused by Safaricom, the meter vendor or your own network being unavailable, beyond refunding a payment that produced no token.

Nothing here limits liability that cannot be limited under Kenyan law, including for death, personal injury or fraud.

Law and disputes

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising from them.

Raise a complaint with your landlord first, since they can see your payment and your token. If it is not resolved, contact us at contact address to confirm.

Changes to these terms

We may change these terms. If a change affects you materially we will tell you in the app at least fourteen days before it takes effect, rather than changing the date at the top and saying nothing. Continuing to use the service after that means you accept the change.
